The court that is responsible for proper distribution of the assets of a decedent is the Probate or Surrogate Court, depending upon the jurisdiction. The Probate or Surrogate Court exists to determine the validity of wills, enforce the provisions of valid wills, and to provide for distribution of assets of those who die intestate, the payment of estate debts after death, the resolution of disputes and claims against the estate, and contests against the Will. The Probate or Surrogate Court may also handle matters concerning guardianship, and conservatorship.
