What is the purpose of the Workers' Compensation Laws?
The workers' compensation laws were formulated to provide an alternative to the traditional tort system. The intent behind the body of workers' compensation laws is to provide reasonable income and medical benefits to work-related accident victims, or income benefits to their dependents, regardless of fault.
What is the compensation rate ?
The State's Commission that is responsible for administering the workers' compensation laws establishes the State's average weekly wage and the injured worker is compensated based on a percentage of that average weekly wage. Awards are usually made in terms of the number of weeks of compensation to which the employee is entitled based on the extent of the disabling injury.
What should an employee do if he or she is injured on the job
An employee who is injured on the job should immediately report the accident to the employer. An employee risk jeopardizing the payment of medical fees and other compensation he or she may be entitled to under the workers' compensation laws if he or she fails to report it. There is a statutory period of time in which an employee must report the injury to the employer and file the claim for compensation. Failure to comply with the timeliness statutes could negate any possible award or other compensation.
